URGENT DECISIONS TAKEN

These are decisions which, because of special circumstances needed to be taken urgently without the normal publication and call-in rules applying.  The decisions are not subject to normal Call-in rules and will be implemented immediately.

Provision is made for such circumstances in the Council's Constitution:

o Rule 15 decisions were taken under the 'General Exception' provision

o Rule 16 decisions were taken under the 'Special Urgency' provision

9.

RULE 3.5.16 - Two month extension of supported bus service 672

Decision maker:  Cabinet Member for Climate and Sustainable Travel, Cabinet Member for Resources

Decision:   Not before 17th Mar 2023

Lead officer:  Pam Turton

Decision status:  Approved

Notice of proposed decision first published: 16/03/2023

This decision will be taken under urgency procedures.

Reason for urgency:
(1) A decision is required before the pre-election period. Delaying until after the pre-election period would leave insufficient time for the decision to be made, and notice given to the current operator to ensure that they will be able to continue the service after the current extension expiores on 31 May 2023. Communities need the reassurance that the 672 will be preserved while the DRT system beds in, givin them further time to transition to DRT. The DRT system will be introduced on 3 April 2023 and other supported services withdrawn on 2 April 2023, with the exception of the services afforded a 2 month extension by B&NES.
(2) The pre-election period commences on 20 March 2023, limiting the ability of members to make a decision.
(3) The current price for the contract extension is affordable, delaying the decision could lead to a change in price.

Anticipated restriction: Open  -

EFP Reference: E3456

These decisions were the subject of a call-in by 9 members.  If the call-in is validated under the rules within the Constitution, the implementation of the decision cannot proceed.  The decision will be examined through the overview and scrutiny process and a recommendation may be made back to the decision maker.  If so, the response of the decision maker (the Cabinet member or the Cabinet, whichever is relevant) will be recorded in a subsequent Weekly List.  Once made, this decision will not be eligible for a further call-in.
