Purpose:

The Care Quality Commission has abolished the star rating system for Care Homes.  In future judgements as to whether a care home is of suitable quality must be made on consideration of inspection reports and other information to hand.  The Amended Policy replaces the 0 rating Policy of November 2009 and sets out the criteria on which judgements on whether placements should be suspended will be made by officers.

Decision:

The Cabinet Member agrees to adopt the revised Policy on Suspension/Restriction of Placements in Care Homes, including the safeguards specified in the policy

Reasons for the decision:

The policy will enable the Council to make fair and transparent decisions in relation to providers who may be at commercial risk, whilst meeting its duty of care towards service users of commissioned Care Home services. This policy amendment enables the council to do this in the context of the new arrangements for regulation of care homes under the Health and Social Care Act 2008 which commence on 1 October 2010

None.  It was necessary to adopt a revised policy as a result of changes to legislation.
