Purpose:
The Council acquired land at Bath Riverside
through Decision E3168 delegated authority delegating contractual
arrangements to the accountable Director. The Site is part owned by
the Council and part owned by a housing developer, St William Homes
LLP (part of the Berkeley group). The Council is party to a land
swap agreement dated 27 January 2022 (LSA) with Berkeley which
enables the parties to swap areas of their individual land
holdings, as the current land ownership boundaries of the site
limit opportunities for development for both parties.
The VEAT is to inform the market of the Council’s intention
to enter into a series of contractual arrangements, including a
remediation and enabling works agreement (REWA), to support a
package of remediation and enabling works at the Bath Western
Riverside Phase II. Subject to grant approval the works will be
funded by grant monies from the Homes England Housing
Infrastructure Fund. The Council’s long-term ambition is the
regeneration of this brownfield site into residential
housing.
Decision:
To publish a VEAT notice to inform the market
of the Council’s intention to enter into a series of
contractual arrangements, including a remediation and enabling
works agreement with Berkeley Homes.
Alternative options considered:
A full technical and legal appraisal has been
undertaken taking into account current land and legal arrangements.
Given the grant funding timeline, efficiencies achieved via a joint
remediation strategy leading to better outcome, as opposed to each
party independently commissioning remediation works to their own
current land ownership.
