Purpose:

The Council has a duty to enforce the Energy Efficiency (Private Rented Property) (England and Wales) Regulations 2015 which are fully implemented from April 2020 and needs to adopt a policy to set out how Officers will enforce the Regulations to maintain minimum energy efficiency standards in the private rented sector.

 

Decision:

The Cabinet Member has considered the matter and agrees that the Council should adopt the Policy as the way the Council will enforce the Energy Efficiency (Private Rented Property) (England and Wales) Regulations 2015

Reasons for the decision:

The policy implements statutory requirements which have been in full effect from April 2020. Enforcement of these Regulations will encourage landlords to improve the energy efficiency of the worst properties, reduce their energy consumption and contribute to reducing the impact of climate change. It will help us reach our target of carbon neutrality by 2030. It important that the enforcement of these Regulations both encourage compliance but at the same time utilise fair and balanced penalties. The financial penalties have been set at a level that is necessary, proportionate, and appropriate.

 

Alternative options considered:

The policy implements statutory requirements and there is limited discretion on the way it is implemented, so this is the only option considered.
