Purpose:

Considerations of responses to parking proposals, included within the Zone TRO 2014

Decision:

The Cabinet Member AGREES that the proposals be implemented, modified or withdrawn as below:

Prohibit and restrict parking At Any Time in lengths of road in Bath and North East Somerset. The affected roads are: Great Bedford Street, Lyncombe Hill, Pera Road, Tyning End, Upper Lansdown Mews, and Wells Road”.

·  Great Bedford Street: That the proposal is withdrawn as the Council received one objection and no responses of support.

·  Lyncombe Hill: That the proposals are withdrawn as the Council received 11 objections and only 4 responses of support.

·  Pera Road: That the proposals are withdrawn as the Council received 9 objections and only 1 response of support.

·  Tyning End: That the proposals are withdrawn as the Council received five objections and no responses of support.

·  Upper Lansdown Mews: That the proposals are withdrawn as the Council received two objections and only one support in part response.

·  Wells Road: That the proposals are implemented as advertised as no objections were received.

“No Waiting Between Monday to Saturday, 8am – 6pm in lengths of road in Bath & North East Somerset. The affected road is: St Ann’s Way”.

·  St Ann’s Way: That the proposals are implemented as the council received 1 response of support for these restrictions and no objections.

“The removal of a Residents Parking Bay in Zone 2 in Bath & North East Somerset. The affected road is: Tyning End”.

·  Tyning End: That the proposals are withdrawn as the Council received five objections and no responses of support.

“Dual use 2 hour Limited Waiting and Resident Parking Bay in Zone 3 in lengths of road in Bath & North East Somerset. The affected road is: Prior Park Road”.

·  Prior Park Road: That the proposals are withdrawn as the Council received six objections and no responses of support.

“Residents Parking in Zone 6 in lengths of road in Bath & North East Somerset. The affected road is James Street West”.

·  James Street West: That the proposal is implemented as advertised as the council received no objections to these restrictions.

“Removal of Car Club Bay and introduction of a Resident Parking bay in Zone 8 in lengths of road in Bath & North East Somerset. The affected road is Bathwick Hill”.

·  Bathwick Hill: That the proposals are implemented as advertised as no objections were received.

“Residents Parking in Zone 4 in lengths of road in Bath & North East Somerset. The affected road is Wells Road”.

·  Wells Road: That the proposals are implemented as advertised as no objections were received.

“Residents Parking in Zone 15 in lengths of road in Bath & North East Somerset. The affected road is Belgrave Crescent”.

·  Belgrave Crescent: That the proposals are withdrawn as the Council received three objections and only one support in part response.

“Disabled Parking Bay in lengths of road in Bath & North East Somerset. The affected road is Widcombe Hill”.

·  Widcombe Hill: That the proposal is implemented as advertised as the council received no objections to these restrictions.

“Removal of Car Club bay and replacement with 2 Hour Limited Waiting in lengths of road in Bath & North East Somerset. The affected road is Sydney Buildings”.

·  Sydney Buildings: That the proposal is implemented as advertised as the council received no objections to these restrictions.

“Loading Bay in lengths of road in Bath & North East Somerset. The affected road is James Street West”.

·  James Street West: That the proposal is implemented as advertised as the council received no objections to these restrictions.

“Removal of Resident Parking Bay and creation of a dual 2 hour limited Waiting and Resident Parking Bay in Bath & North East Somerset. The affected road is Lyncombe Hill”.

·  Lyncombe Hill: That the proposals are withdrawn as the Council received 11 objections and only 4 responses of support.

Reasons for the decision:

The proposals were developed as the result of the concerns of the Traffic & Safety, Parking and Traffic Management Team, Ward Councillors and local residents caused by increasing problems related to parking, which is becoming a greater concern on many streets around Bath & North East Somerset due to the increasing volume of vehicles on our roads and the growing number of vehicles parking inappropriately. There are no rights to park on the highway but parking is condoned where the right of passage along the highway is not impeded. The consideration of objections to the introduction of controls has to be considered in this context. There is also no legal right to park on the highway either outside a property or even within a specific street, howevera number of the comments received stated that the parking situation in some of these locations is self-regulating between residents and that new restrictions are not required. The Council therefore due to the strength and number of objections towards some of the proposals recommended they be abandoned at this time.

Alternative options considered:

To implement all restrictions as advertised

This option was rejected based on the public feedback and objections to the proposals as advertised.

Not to implement any of the schemes

This option was rejected as the proposals recommended for implementation improve the parking and traffic flow on the specified roads.
