Purpose:
The Localism Act 2011 has reformed the
planning system to give local people new rights to shape the
development of the communities in which they live.
The Act provides for a new type of community-led initiative known
as a Neighbourhood Development Plan which sets out the policies on
the development and use of land in a parish or ‘Neighbourhood
Area’.
The Council has a duty to assist communities in the preparation of
Neighbourhood Development Plans and orders and to take a Plan
through a process of examination and referendum and to bring the
Neighbourhood Plan into force
Decision:
Having considered the examiner’s
recommendations and reasons for them, B&NES Council concur with
the examiner’s view and have decided to make modifications to
the Neighbourhood Plan to ensure that it meets legal requirements
including the Basic Conditions as set out in legislation. Appendix
1 sets out the modifications to be made in response to the
examiner’s recommendations, together with the reasons for
them.
The Council are satisfied that the as modified complies with the
legal requirements and can proceed to referendum.
The Council also agree with the examiner that there is no reason to
extend the Neighbourhood Plan Area (beyond the High Littleton and
Hallatrow Neighbourhood Area) for the purpose of holding the
referendum.

No other options were considered given the
Council has a duty to assist communities in the preparation of
Neighbourhood Development Plans and orders and to take a Plan
through a process of examination and referendum and to bring the
Neighbourhood Plan into force.
