Purpose:
To enable officers with the technical
knowledge of Council Tax, non-domestic rates and housing benefts to
initiate and conduct proceedings in the recovery of non
payments.
Decision:
With effect from 07.09.2023 and in accordance
with part 2.35.5 of the Bath and North East Somerset Constitution
the Legal Services Manger hereby delegates authority to

Stephen Maddison
The power to : -
•Initiate and conduct proceedings in the Magistrates Court
with regard to non-payment of Council Tax in accordance with Part
VI of the Council Tax (Administration and Enforcement) Regulations
1992
•Initiate civil proceedings in the County Court with regard to
recovering over-payments of Housing Benefit in accordance with Part
III of the Social Security Administration Act 1992
•Conduct proceedings at Valuation Tribunal with regard to
Council Tax and Non-Domestic Rates appeals in accordance with
section 16 of the Local Government Finance Act 1992
Alternative options considered:
Option 1 - delegate authority to Revs and Bens
officers to recover non payments.
Option 2 - instruct external legal representation to recover non
payments
Option 1 is the most appropriate option
