Legal Fees and Charges July 2022 revision

Decision Maker: Monitoring Officer

Decision status: Approved

Is Key decision?: No

Is subject to call in?: No

Purpose:

Unlike statutory fees and charges Local Authorities are not constrained in how they calculate and apply fees and charges for discretionary services they provide. This means the full costs of all aspects of a services provided can be recovered and monies received invested in Council services.

A report published on the weekly list dated 20.08.2021 obtained approval from the Member for Resources and Economic Development to review of Legal Fees on an upward only basis
in accordance with CPI until July 2023. Given the continued financial pressures facing the Council and the Office of National Statistics latest forecast for UK CPI being 9.1% the Fees and Charges have been revised accordingly.

Decision:

To revise the schedule of Legal Fees and Charges in accordance with CPI

Alternative options considered:

Given the financial pressures facing the council and the charges are applied to the commercial sector in the recovery of fees for professional services not increasing the fees was not considered an option.
