1 THE ISSUE

1.1 This paper gives Trustees an update on lettings at the Recreation Ground since the last Trust Board meeting and seeks authority to agree a letting with a film production company for part of the Recreation Ground.

2 RECOMMENDATION

The Trust Board is asked to:

2.1 Note the lettings situation

2.2 Agree to the use of part of the Trust land in association with the filming of "The Duchess" upon payment of an appropriate fee to be negotiated by Trust Advisers.

3 FINANCIAL IMPLICATIONS

3.1 Lettings provide part of the income of the Trust as reported in regular financial reports to the Trust Board.

4 THE REPORT

4.1 Attached at Appendix 1 is a summary of lettings granted over the Recreation Ground since the start of the year, and known future lettings over the next period.

4.2 Attached at Appendix 2 is a request from a film production company to use part of the Recreation Ground in association with their filming in adjoining streets of Bath in November of this year.

4.3 This proposed use does not fit within the aims and objectives of the Trust. The Trust Board may wish to agree to this proposal, however, on the basis that:

It will reduce the adverse effect of the filming on neighbours adjoining the Trust's land.

A fee is payable to the Trust which will contribute to the upkeep of the Recreation Ground to better meet its aims and objectives.

5 RISK MANAGEMENT

5.1 Not applicable for this report.

6 RATIONALE

6.1 In terms of the letting in association with the Duchess filming the proposal does allow the Trust to assist reducing the effect of the filming on its neighbours and brings in a source of income to the Trust.

7 OTHER OPTIONS CONSIDERED

7.1 Not allowing the letting to the Duchess film producers. This option will mean that neighbours of the trust have to experience some inconvenience during the filming period which could be offset by the proposal. A potential source of income would be lost.

8.1 Deputy Section 151 Finance Officer

9 ISSUES TO CONSIDER IN REACHING THE DECISION

9.1 The trust has to weigh the benefits of this proposal against the fact that it does not fit within the aims and objectives of the Trust.

9.2 The Trust will need, as always, to gain best consideration for the agreement if granted.

10 ADVICE SOUGHT

10.1The Council's Monitoring Officer (Council Solicitor) and Section 151 Officer have had the opportunity to input to this report and have cleared it for publication.
