PRESENT -: Councillors: Hattie Ajderian, David Bellotti and Tim Warren (Chair(person) and substitute for Les Kew).

Also in attendance: Joanna Gregson (Licensing Officer), Francesca Smith (Solicitor) and Nathalie Romain (Legal Advisor).

1 ELECTION OF CHAIR(PERSON)

Councillor Bellotti nominated Councillor Kew to become Chair(person), this nomination was seconded by Councillor Ajderian. No other nominations were made and the Sub-Committee RESOLVED that Councillor Kew become Chair(person) of the Licensing (Alcohol, Late Night Refreshment & Entertainment) Sub-Committee and would serve until its first meeting after the Annual Council Meeting held in May 2007.

2 EMERGENCY EVACUATION PROCEDURE

The Chair(person) drew attention to the emergency evacuation procedure as set out on the Agenda.

3 ELECTION OF VICE-CHAIR(PERSON) (IF DESIRED)

The Sub-Committee RESOLVED that a Vice-Chair(person) was not required on this occasion.

4 DECLARATIONS OF INTEREST

There were none.

5 TO ANNOUNCE ANY URGENT BUSINESS AGREED BY THE CHAIR(PERSON)

There was none.

The Sub-Committee RESOLVED that the minutes of the meetings held on Wednesday 15th March 2006, Monday 20th March 2006 and Monday 3rd April 2006 be confirmed as a correct record and signed by the Chair(person).

7 LICENSING PROCEDURE

The Chairman drew attention to the procedure for the Sub-Committee, copies of which had been made available to the public who were present.

8 APPLICATION FOR A PREMISES LICENCE FOR THE BATH FESTIVAL OPENING NIGHT, KINGSTON PARADE, BATH. BA1 1LY.

The Sub-Committee considered the application for a new Premises Licence under the Licensing Act 2003 in respect of the Bath Festival Opening Night, Kingston Parade, Bath. BA1 1LY.

The Applicant was present, put his case and was questioned.

Parties who had made a relevant representation were present, put their case and were questioned.

The Sub-Committee took into account the licensing objectives as set out in the Licensing Act 2003 Section 4, particularly, (i) prevention of public nuisance.

Following an adjournment it was

RESOLVED

The Sub-Committee decided to grant the application for a Premises Licence subject to the following conditions, namely:

Subject to the additional conditions as specified in the operating schedule.

Subject also to the following times for regulated entertainment, namely -

Provision of Regulated Entertainment (by way of Recorded Music, Performance of Dance, Entertainment of a Similar Description and the Provision of Facilities for Dancing) -

The Sub-Committee delegates power to the Licensing Officer to issue the Licence accordingly.

REASONS

The Sub-Committee listened very carefully to the representations made by the applicant and, in particular, to those of the parties that made relevant representations. The Sub-Committee noted that the applicant had demonstrated that wide consultation had been made with various statutory bodies and voluntary organisations with regard to the application, and, as the application for a few hours only, that the event would end relatively early in the evening and that the applicant was not seeking to sell alcohol, that the licence should be granted on the terms applied for. In addition, they were happy that the applicant had agreed to nominate a designated person for residents to contact if they wished to make a complaint when the event itself was taking place.
