MINUTES OF REGULATORY (ACCESS) COMMITTEE

Tuesday 9th October 2007

PRESENT -: Councillors: Chris Cray (Chairman), Neil Butters, Nicholas Coombes and Brian Simmons (substitute for Tim Warren).

Also in attendance: Will Steel (Team Leader - Public Rights of Way PROW), Jenny King (Definitive Map Project Officer), Simon Elias (Legal Adviser), Stuart Higgins (PROW Technician and Jack Latkovic (Democratic Services Officer).

15 EMERGENCY EVACUATION PROCEDURE

The Democratic Services Officer drew attention to the emergency evacuation procedure as set out on the Agenda.

16 ELECTION OF VICE-CHAIR(PERSON) (IF DESIRED)

RESOLVED that a Vice-Chair(person) was not required on this occasion.

17 APOLOGIES FOR ABSENCE AND SUBSTITUTIONS

Councillor Tim Warren sent his apology for this meeting. Councillor Brian Simmons was his substitute.

21 ITEMS FROM COUNCILLORS AND CO-OPTED AND ADDED MEMBERS

Councillor Nicholas Coombes, Bathwick Ward Councillor, asked the PROW officers to give an update on the creation of a cycle path from Bathwick to Combe Down and also to explain why there was a delay on providing a footbridge at the Bath University in Bathwick.

The officers explained that the order to record a Public Footpath between Bathwick and Combe Down had been made but a number of objections had been lodged. Due to the complexity of this case (relating mainly to conflicting user evidence) the matter was being researched by an independent consultant. It is hoped that the matter would be reported back to the Committee in either January 08 or April 08 before being submitted to the Planning Inspectorate for a decision. Construction of a cycle route was a separate issue which would follow the determination of the footpath order.

The officers also explained that PROW team constantly was putting pressure on Bath University for progress on the footbridge.

The Chair thanked the officers on these updates.

Following the debate the Committee RESOLVED that the PROW Team Leader draft the letter on behalf of the Committee to Bath University expressing the need for the University to resolve the matter and progress the construction of a replacement footbridge without any further delay.

22 MINUTES: TUESDAY 10TH JULY 2007

It was RESOLVED that the minutes of the meeting on Tuesday 10th July 2007 be confirmed as a correct record and signed by the Chairman.

23 DEFINITIVE MAP MODIFICATION ORDER TO ADD 22 PUBLIC FOOTPATHS IN KINGSMEAD, BATH (Report 9)

The Committee considered the evidence relating to 26 alleged public rights of way in Kingsmead Ward (a number of paths cross the ward boundaries into Abbey, Newbridge, Westmoreland & Widcombe Wards), Bath and whether to approve the recommendation to make a Definitive Map Modification Order (DMMO), to record 22 of these paths on the Definitive map and Statement for the City of Bath.

It was moved by Councillor Neil Butters, seconded by Councillor Nicholas Coombes, and unanimously RESOLVED that the Assistant Director Environmental Services be granted delegated authority to take all action to make an Order to Modify the Definitive Map and Statement by adding the public rights of way as shown on the plans, and to confirm the Order if no duly made objections were received to the Order.

24 UPDATE OF DEFINITIVE MAP ORDER AND PUBLIC PATH ORDER WORK (Report 10)

The Committee considered the update on the present position regarding the Definitive Map Order and Public Path Order.

It was RESOLVED to note the report.

25 NOTICE OF ITEMS FOR FUTURE MEETINGS

The Public Rights of Way Team Leader informed the Committee that the order to record a footpath from Bathwick to Combe Down would be before the Committee for the January or April 08 meeting.

It was RESOLVED to note the verbal update.
