MINUTES OF REGULATORY (ACCESS) COMMITTEE

Tuesday 30th June 2009

PRESENT -: Councillors: Chris Cray (Chairman), Neil Butters, Tim Warren and Nicholas Coombes (substitute for Shaun McGall)

Also in attendance: Will Steel (Team Leader - Public Rights of Way PROW), Simon Elias (Legal Adviser), Graeme Stark (Public Rights of Way Mapping Officer), and Jack Latkovic (Democratic Services Officer).

1 EMERGENCY EVACUATION PROCEDURE

The Democratic Services Officer drew attention to the emergency evacuation procedure as set out on the Agenda.

2 ELECTION OF VICE-CHAIR(PERSON) (IF DESIRED)

RESOLVED that a Vice-Chair(person) was not required on this occasion.

3 APOLOGIES FOR ABSENCE AND SUBSTITUTIONS

Apology was received from Councillor Shaun McGall. Councillor Nicholas Coombes was substitute for Councillor McGall.

4 DECLARATIONS OF INTEREST

There were none.

5 TO ANNOUNCE ANY URGENT BUSINESS AGREED BY THE CHAIR(PERSON)

There was none.

6 ITEMS FROM THE PUBLIC - TO RECEIVE DEPUTATIONS, STATEMENTS, PETITIONS OR QUESTIONS

There were none.

7 ITEMS FROM COUNCILLORS AND CO-OPTED AND ADDED MEMBERS

Councillor Neil Butters informed the Committee that he spoke with the Somer Housing representative on the issue that he raised at the last meeting of the Committee. Councillor Butters said that Somer Housing wanted to buy back a piece of land in Shoscombe that they had previously sold but that due to the rules and regulations they were not allowed to do that. He asked the Public Rights of Way Team Leader if he knew more about that matter.

The Public Rights of Way Team Leader said that he had not heard anymore about that issue since the last meeting.

8 MINUTES: TUESDAY 7TH APRIL 2009

It was RESOLVED that the minutes of the meeting on Tuesday 7TH April 2009 be confirmed as a correct record and signed by the Chair.

9 PUBLIC PATH ORDER DIVERSION (OBJECTION) - BELLUTON FARM, BELLUTON, PUBLOW/PENSFORD (Report 9)

The Public Rights of Way Mapping Officer introduced the report.

It was moved by Councillor Neil Butters, seconded by Councillor Tim Warren, and unanimously RESOLVED to abandon the Order.

10 PUBLIC PATH ORDER DIVERSION (APPLICATION) - WELTON GROVE, MIDSOMER NORTON (Report 10)

The Public Rights of Way Mapping Officer introduced the report.

It was moved by Councillor Nicholas Coombes, seconded by Councillor Neil Butters, and unanimously RESOLVED not to proceed with the application for diversion of Public Footpath CL24/29.

11 PUBLIC PATH EXTINGUISHMENT ORDER - NEMPNETT THRUBWELL (Report 11)

The Public Rights of Way Mapping Officer introduced the report.

It was moved by Councillor Tim Warren, seconded by Councillor Neil Butters, and unanimously RESOLVED not to proceed with the application to extinguish Public Footpath CL14/45.

12 UPDATE OF DEFINITIVE MAP ORDER AND PUBLIC PATH ORDER WORK (Report 12)

The Chair invited the Public Rights of Way Mapping Officer to give an update.

The Public Rights of Way Mapping Officer went through the update with the Committee Members.

The officers informed the Committee about the waiting time, and what causes delays, in processing Definitive Map Order and Public Path Order applications. They also explained that they would, when processing Definitive Map Modification Order applications, look for evidence dated back from 18th century if available.

The Chairman asked the Public Rights of Way Team Leader to investigate, and report back to the Committee, the reasons for the delay in contractors cutting back overgrowth on footpaths.

It was RESOLVED to note the report and for the Public Rights of Way Team Leader to carry out investigation as per Chairman's request.
