MINUTES OF REGULATORY (ACCESS) COMMITTEE

Tuesday 8th July 2008

PRESENT -: Councillors: Chris Cray (Chairman), Caroline Roberts (substitute for Neil Butters), Stephen Willcox and Nicholas Coombes

Also in attendance: Will Steel (Team Leader - Public Rights of Way PROW), Simon Elias (Legal Adviser), Jenny King (City of Bath Definitive Map Project Officer), Alan Harbour (Definitive Map Officer) and Jack Latkovic (Democratic Services Officer).

1 EMERGENCY EVACUATION PROCEDURE

The Democratic Services Officer drew attention to the emergency evacuation procedure as set out on the Agenda.

2 ELECTION OF VICE-CHAIR(PERSON) (IF DESIRED)

RESOLVED that a Vice-Chair(person) was not required on this occasion.

8 MINUTES: TUESDAY 8TH APRIL 2008

It was RESOLVED that the minutes of the meeting on Tuesday 8th April 2008 be confirmed as a correct record and signed by the Chair.

9 DEFINITIVE MAP MODIFICATION ORDER TO ADD 46 PUBLIC RIGHTS OF WAY IN ABBEY WARD, BATH (Report 9)

The Chair invited the City of Bath Definitive Map Project Officer to introduce the report.

The City of Bath Definitive Map Project Officer informed the meeting that two footpaths (AQ192 and AQ440) had had legal orders made for them by the Secretary of State in 1961 and therefore would not be included in the recommendation for this Committee to approve.

It was moved by Councillor Nicholas Coombes, seconded by Councillor Stephen Willcox, and RESOLVED to grant delegated authority to the Divisional Director for Environmental Services to take all action to make an Order to modify the Definitive Map and Statement by adding the public rights of way as shown on the plans in the report, and without footpaths AQ192 and AQ440, and to confirm the Order if no duly made objections are received to the Order and not subsequently withdrawn.

The Chairman used this opportunity to thank the City of Bath Definitive Map Project Officer for the hard work that she had done for this report. He also wished her the best when she goes on her maternity leave in near future.

10 DIVERSION OF PUBLIC FOOTPATH BA26/15, DUNDRY HILL FARM - AUTHORISATION FOR BRISTOL CITY COUNCIL TO MAKE A PUBLIC PATH DIVERSION ORDER (Report 10)

The Chair invited the Public Rights of Way team Leader to introduce the report.

The Public Rights of Way Team Leader gave an introduction to the Committee on this matter.

It was moved by Councillor Caroline Roberts, seconded by Councillor Stephen Willcox, and RESOLVED to approve the proposed diversion of Public Footpath BA26/15 as set out in the report and also to authorise the Solicitor to the Council to enter into an agreement with Bristol City Council under section 101 of the Local Government Act 1972 and all other enabling powers to discharge to Bristol City Council, this Council's function in respect the proposed diversion of Public Footpath BA26/15 under section 119 of the Highways Act 1980.

11 UPDATE OF DEFINITIVE MAP ORDER AND PUBLIC PATH ORDER WORK (Report 11)

The Chair invited the Definitive Map Officer to give an update.

The Definitive Map Officer went through the update with the Committee Members.

It was RESOLVED to note the report.

At this point of the meeting the Chairman expressed his concerns regarding the staffing of the Public Rights of Way team. He asked the Public Rights of Way Team Leader to set a meeting between two of them and also asked that the Head of Human Resources or adequate Personnel Manager be present at the meeting to discuss this issue.

The Public Rights of Way Team Leader informed the Committee that there were no specific items at this stage for future meetings
