1 EMERGENCY EVACUATION PROCEDURE

The Committee Administrator drew attention to the emergency evacuation procedure as set out on the Agenda.

2 ELECTION OF VICE-CHAIR(PERSON) (IF DESIRED)

There was no vice-chair (person) elected.

3 DECLARATIONS OF INTEREST

There were no declarations of interest made.

4 TO ANNOUNCE ANY URGENT BUSINESS AGREED BY THE CHAIR(PERSON)

There were no items of urgent business.

5 ITEMS FROM THE PUBLIC - TO RECEIVE DEPUTATIONS, STATEMENTS, PETITIONS OR QUESTIONS

The Committee noted that Members of the Public speaking with regards to specific items would have the opportunity to do so immediately preceding those items on the agenda.

6 ITEMS FROM COUNCILLORS AND CO-OPTED AND ADDED MEMBERS

There were no items from Councillors.

7 MINUTES: THURSDAY 14TH OCTOBER 2004

RESOLVED that the minutes of the meeting held on Thursday 14th October 2004 be confirmed as a correct record and signed by the Chair(person).

8 PRINCIPLES OF OPERATION FOR THE REGULATORY (ACCESS) COMMITTEE - COMMITTEE PROCEDURES (Report 9).

This report would provide guidance to Committee Members, Officers and Members of the Public on how the Regulatory (Access) Committee would consider matters relating to Definitive Map Modification Orders ("DMMOs"), Public Path Orders ("PPOs"), and Commons Registration (including Town and Village Greens ("TVG")). There was also a need to simplify the two public speaking schemes that currently apply at this Committee.

The Committee was asked to agree with the Principles of Operation for the Regulatory (Access) Committee.

The Chair welcomed suggestion from Councillor Tim Bullamore, Weston Ward Councillor, that this document should be circulated to every Member of the Bath & North East Somerset Council.

On a motion from Councillor Todd and seconded by Councillor Gerrish, with unanimous vote For, it was RESOLVED that:

(1) That the Principles of Operation for the Regulatory (Access) Committee be adopted in its' proposed format.

(2) That the copy of the Principles of Operation for the Regulatory (Access) Committee be circulated to all Members of the Council.

9 DEFINITIVE MAP MODIFICATION ORDER TO ADD A PUBLIC FOOTPATH AT CLAVERTON DOWN (Report 10).

The Committee received a report which explained that Officers have discovered evidence that they consider sufficient to require the making of an Order to add a public footpath to the Definitive Map and Statement (DMS) at Claverton Down, Bath.

The Committee also considered:

· Late Observations Update by Bath Definitive Map Project Officer on Report 10 attached as Appendix 1 to these Minutes

· Oral statement by Member of the Public, the Speakers List being attached as Appendix 2 to these Minutes

The Chair thanked Officer for detailed presentation. On a motion from Councillor Todd, seconded by Councillor Willcox, it was RESOLVED that the application, in its' updated version, for a Definitive Map Modification Order to add a Public Footpath at Claverton Down be accepted and that the Head of Transportation and Highways be granted delegated authority to take all action to make an Order to Modify the Definitive Map and Statement by adding a public footpath between Widcombe Hill and Claverton Down Road, Bath. Voting: All in Favour. Motion carried.

10 DEFINITIVE MAP MODIFICATION ORDER (DMMO) TO ADD 26 PUBLIC FOOTPATHS IN WESTON WARD (Report 11).

The Committee received a report which explained that Bath and North East Somerset Council has received an application to add 26 public footpaths to the Definitive Map and Statement (DMS) in Weston Ward, Bath. The Committee was asked to approve the making of a Definitive Map Modification Order (DMMO) to add the footpaths to the DMS.
The Committee also considered:

· Late Observations Update by Bath Definitive Map Project Officer on Report 11 attached as Appendix 3 to these Minutes

· Oral statement by Councillor Tim Bullamore, Weston Ward Councillor.

Councillor Tim Bullamore expressed his gratitude for a thorough report and vast amount of clear information present in this report. He welcomed this report but he asked Officers to give a clear answer whose responsibility is to maintain those footpaths in Weston Ward.Officers informed Committee that maintenance of those paths would be undertaken by the Council.

The Chair thanked Officers for their presentation. On a motion from Councillor Todd, seconded by Councillor Willcox, it was RESOLVED that the application, in its' updated version, for a Definitive Map Modification Order to add 26 public footpaths in Weston Ward be accepted and that the Head of Transportation and Highways be granted delegated authority to take all action to make an Order to Modify the Definitive Map and Statement by adding the public footpaths as shown on the plans.

Voting: All in Favour. Motion carried.

The Chair, on behalf of the Committee, thanked the Public Rights of Way team for all of the hard work that they have put into this Report.

11 DEFINITIVE MAP MODIFICATION ORDER (DMMO) TO ADD A PUBLIC FOOTPATH AT CINEMA SITE, KEYNSHAM (Report 12).

The Committee received a report which explained that Bath and North East Somerset Council has received an application for a Definitive Map Modification Order to be made under section 53(2) of the Wildlife and Countryside Act 1981 to modify the Definitive Map and Statement by adding a public footpath which would lead off Culvers Road, Keynsham around the former cinema site, through the public car park, to egress on to the High Street by the Old Bank public house. The Committee was asked to approve the making of a Definitive Map Modification Order (DMMO) to add the footpaths to the DMS.
The Committee also considered:

· Oral statement by Member of the Public, the Speakers List being attached as Appendix 2 to these Minutes

The Chair thanked Officers for their presentation. On a motion from Councillor Todd, seconded by Councillor Gerrish, it was RESOLVED that the application to add a public footpath which leads off Culvers Road, Keynsham around the former cinema site, through the public car park, to egress on to the High Street by the Old Bank public house and that the Head of Transportation and Highways be granted delegated authority to take all action to make an Order to Modify the Definitive Map and Statement by adding a public footpath between Culvers Road and the High Street, Keynsham. Voting: All in Favour. Motion carried.

12 UPDATE OF DEFINITIVE MAP ORDER AND PUBLIC PATH ORDER WORK (Report 13).

The Committee was asked to note the present position regarding Definitive Map Order and Public Path Order work.

On a motion from Councillor Todd, seconded by Councillor Willcox it was RESOLVED that the current position regarding Definitive Map Order and Public Path Order work and the satisfactory progress being made be noted.

13 NOTICE OF ITEMS FOR FUTURE MEETINGS (Report 14).

RESOLVED to note that the next meeting of the Committee will be on 14th April 2005.
