25 EMERGENCY EVACUATION PROCEDURE

The Chair drew attention to the emergency evacuation procedure as set out on the Agenda.

26 ELECTION OF VICE-CHAIR(PERSON) (IF DESIRED)

There was no vice-chair(person) elected.

27 DECLARATIONS OF INTEREST

There were no declarations of interest made.

There were no items of urgent business.

29 ITEMS FROM THE PUBLIC - TO RECEIVE DEPUTATIONS, STATEMENTS, PETITIONS OR QUESTIONS

The Chair explained that there was one person, a Mr Ellis, who had notified the Council of his intention to make a Statement in connection with the Report 9 - Definitive Map Modification Order to add a Public Footpath across St Nicholas Court in Bathampton. Mr Ellis was not present. Members of the Committee agreed with the Chair to consider this report after Report 11 in case Mr Ellis arrived in the interim.

31 MINUTES: THURSDAY 8TH JULY 2004

RESOLVED that the minutes of the meeting held on Thursday 8th July 2004 be confirmed as a correct record and signed by the Chair.

32 DEFINITIVE MAP MODIFICATION ORDER (DMMO) TO ADD A PUBLIC FOOTPATH AT POOL BARTON, KEYNSHAM (Report 10).

The Committee received a report which explained that Bath and North East Somerset Council has received an application to add a public footpath to the Definitive Map and Statement (DMS) at Pool Barton, Keynsham. The Committee was asked to approve the making of a Definitive Map Modification Order (DMMO) to add the used footpath to the DMS.

Councillor Charles Gerrish made a statement where he expressed support for this application. He said that it would be much safer if this public footpath is recognised and maintained by the Council.

On a motion from Councillor Todd, seconded by Councillor Warren, it was RESOLVED that the application for a Definitive Map Modification Order to add a Public Footpath across at Pool Barton in Keynsham be accepted, and that that the Head of Transportation and Highways be granted delegated authority to take all action to make an Order to Modify the Definitive Map and Statement by adding a public footpath from the westernmost end of Pool Barton, Class 4 Road number 48634 to the intersection of Public Footpaths BA27/5 and BA27/6, Keynsham, as shown by the route marked A-B-C on the plan attached as Appendix 1 to the report, and to confirm the Order if no duly made objections are sustained.

33 DEFINITIVE MAP MODIFICATION ORDER (DMMO) TO ADD A PUBLIC FOOTPATH ON LAND BETWEEN VENUS LANE AND CHURCH LANE, CLUTTON (Report 11).

The Committee received a report which explained that Bath and North East Somerset Council has received an application to add a public footpath to the Definitive Map and Statement (DMS) on land between Venus Lane and Church Lane. The Committee was asked to approve the making of a Definitive Map Modification Order (DMMO) to add the used footpath to the DMS.

On a motion from Councillor Warren, seconded by Councillor Todd, it was RESOLVED that the application for a Definitive Map Modification Order to add a Public Footpath across land between Venus Lane and Church Lane., Clutton be accepted, and that that the Head of Transportation and Highways be granted delegated authority to take all action to make an Order to Modify the Definitive Map and Statement by adding a public footpath between Venus Lane and Church Lane, Clutton, as shown marked A-B at Appendix 1 to the report, and to confirm the order if no duly made objections are sustained.

34 DEFINITIVE MAP MODIFICATION ORDER TO ADD A PUBLIC FOOTPATH ACROSS ST NICHOLAS COURT, BATHAMPTON (Report 9).

The Committee received a report which explained that Bath and North East Somerset Council has received an application to add a public footpath to the Definitive Map and Statement (DMS) across St Nicholas Court in Bathampton. The Committee was asked to approve the making of a Definitive Map Modification Order (DMMO) to add the used footpath to the DMS.

Councillor Chris Cray (Chair) informed Members of the Committee that he was not anymore member of the Somer Community Housing Trust Board and therefore would take part in debate and voting on this matter.

The Committee regretted that Mr Ellis who had requested to speak in regards of this report was not present, but Members were informed from the Public Rights of Way Officer about the nature of his statement.

On a motion from Councillor Todd, seconded by Councillor Warren, it was RESOLVED that the application for a Definitive Map Modification Order to add a Public Footpath across land at St Nicolas Court be accepted, and that the Head of Transportation and Highways be granted delegated authority to take all action to make an Order to Modify the Definitive Map and Statement by adding a public footpath at St Nicholas Court, Bathampton as shown marked A-B-C at Appendix 1 to this report, and to confirm the order if no duly made objections are sustained.

Councillor Griffiths asked for her vote to be recorded as she voted against the motion.

35 UPDATE OF DEFINITIVE MAP ORDER AND PUBLIC PATH ORDER WORK (Report 12).

The Committee was asked to note the present position regarding Definitive Map Order and Public Path Order work.

The Committee congratulated the Public Rights of way Officers on their commitment and hard work.

On a motion from Councillor Todd, seconded by Councillor Warren it was RESOLVED that the current position regarding Definitive Map Order and Public Path Order work and the satisfactory progress being made be noted.

36 NOTICE OF ITEMS FOR FUTURE MEETINGS (Report 13).

RESOLVED to note the future dates of the Committee meetings which were circulated to the Members.
