13 EMERGENCY EVACUATION PROCEDURE

The Chair drew attention to the emergency evacuation procedure as set out on the Agenda.

14 ELECTION OF VICE-CHAIR(PERSON) (IF DESIRED)

Councillor Tim Warren was elected to take the Chair for Item 10.

15 DECLARATIONS OF INTEREST

Councillor Chris Cray declared a personal and prejudicial interest in the Agenda Item 10 relating to Definitive map Modification Order to add a Public Footpath across St Nicholas Court in Bathampton, due to being a member of the Somer Community Housing Trust Board and therefore would not take part in its consideration. Councillor Tim Warren was appointed as Chair for this item only.

17 ITEMS FROM THE PUBLIC - TO RECEIVE DEPUTATIONS, STATEMENTS, PETITIONS OR QUESTIONS

Mr Edward Galizia made a short statement in regards to Agenda Item 11, Bath & North East Somerset Council (Footpaths BA 19/1 Peasedown St John & BA4/40 (Part) Camerton, Carlingcott Mill) Public Path Diversion Order 2004.

19 MINUTES: THURSDAY 16TH OCTOBER 2003

RESOLVED that the minutes of the meeting held on Thursday 16th October 2003 be confirmed as a correct record and signed by the Chair.

20 DEFINITIVE MAP MODIFICATION ORDER TO ADD A PUBLIC FOOTPATH ACROSS THE BATCH, BISHOP SUTTON (Report 9)

The Committee received a report which explained that Bath and North East Somerset Council has received an application to add a public footpath to the Definitive Map and Statement (DMS) at The Batch, Bishop Sutton. The Committee was asked to approve the making of a Definitive Map Modification Order (DMMO) to add the used footpath to the DMS.

On a motion from Councillor Dawson, seconded by Councillor Griffiths, it was RESOLVED that proposed application for a Definitive Map Modification Order to add a Public Footpath across The Batch in Bishop Sutton be approved.

The Head of Transportation Access and Waste Management be granted delegated authority to take all action to make a Modification Order to modify the Definitive Map and Statement by adding a footpath at the Batch, Bishop Sutton as shown marked A-B-C on the plan accompanying this report and to confirm the Order if no duly made objections are received (or if received are subsequently withdrawn).

21 DEFINITIVE MAP MODIFICATION ORDER TO ADD A PUBLIC FOOTPATH ACROSS ST NICHOLAS COURT, BATHAMPTON (Report 10)

(Councillor Tim Warren chaired the meeting for this item only)

The Committee received a report which explained that Bath and North East Somerset Council had received an application to add a public footpath to the Definitive Map and Statement (DMS) across St Nicholas Court in Bathampton.

The Committee was advised that officers from Public Rights of Way had received today a late submission from Somer Community Housing Trust in respect of this application. Following discussion The Committee RESOLVED that in order to consider the matter raised in the late submission fully, it would be necessary to defer this report until the next meeting. The Committee expressed its disappointment at the late submission of these documents and indicated that documentary evidence upon which it is intended to rely at the adjourned hearing should be submitted to the Head of Transportation Access and Waste Management not less than 14 working days before the hearing so that it may be circulated to members of the committee in advance of the hearing.

22 BATH & NORTH EAST SOMERSET COUNCIL (FOOTPATHS BA19/1 PEASEDOWN ST. JOHN & BA4/40 (PART) CAMERTON, CARLINGCOTT MILL) PUBLIC PATH DIVERSION ORDER 2004 (Report 11)

The Committee considered the objection made to the Bath and North East Somerset Council (Footpaths BA 19/1 Peasedown St John & BA 4/40 (Part) Camerton, Carlingcott Mill) Public Path Diversion Order 2004 prior to forwarding the Order to the Secretary of State for the Environment, Food and Rural Affairs.

The Committee considered a statement made by the applicant Mr Galizia, objection letters from Camerton Parish Council and Peasedown St John Parish Council and documents received on 15th September 2003 in support of the diversion from a local resident.

Copies of the statement, letters, objection and the document from a local resident circulated to the Committee are available on the minute book.

On a motion from Councillor Dawson, seconded by Councillor Warren, it was RESOLVED that the Bath and North East Somerset Council (Footpaths BA 19/1 Peasedown St John & BA 4/40 (Part) Camerton, Carlingcott Mill) Public Path Diversion Order 2004 be forwarded to the Secretary of State for the Environment, Food and Rural Affairs with the request that she confirms the Order as made.

23 UPDATE OF DEFINITIVE MAP ORDER AND PUBLIC PATH ORDER WORK (Report 12)

The Committee was asked to note the current workload and content regarding claims/applications to modify the Definitive Map & Statement and to divert public paths.

On a motion from Councillor Dawson, seconded by Councillor Griffiths it was RESOLVED that the current position regarding Public Rights of Way Order work and the satisfactory progress being made be noted.

24 NOTICE OF ITEMS FOR FUTURE MEETINGS

The Committee has noted that two items will appear on next meeting, along with the other items: a) Definitive Map Modification Order to add a public footpath across St Nicholas Court in Bathampton and b) Definitive Map Modification Order to add a public footpath across Pool Barton in Keynsham.
