1 CHAIR(PERSON)

The Chair welcomed everyone to the meeting and introduced Members of the Committee.

RESOLVED that the Council has agreed that Councillor Chris Cray (Independent Group) be the permanent Chair for this Committee for this municipal year.

2 EMERGENCY EVACUATION PROCEDURE

The Committee Administrator drew attention to the emergency evacuation procedure as set out on the Agenda.

3 ELECTION OF VICE-CHAIR(PERSON) (IF DESIRED)

There was no vice-chair(person) elected.

4 DECLARATIONS OF INTEREST

There were no declarations of interest made.

5 TO ANNOUNCE ANY URGENT BUSINESS AGREED BY THE CHAIR(PERSON)

6 ITEMS FROM THE PUBLIC - TO RECEIVE DEPUTATIONS, STATEMENTS, PETITIONS OR QUESTIONS

Mr Edward Galizia, the applicant, made a statement regarding item 10, Application for the Diversion of Public Footpaths BA19/1 (Peasedown St. John) and Part of BA4/40 (Camerton) at Carlingcott Mill. Mr Galizia circulated additional photographs, of anti-social behaviour occurring outside of the Mill, to the Committee.

A copy of the statement was circulated to the Committee. A copy is available on the minute book.

8 MINUTES: THURSDAY 27TH MARCH 2003

RESOLVED that the minutes of the meeting held on Thursday 27th March 2003 be confirmed as a correct record and signed by the Chair(person).

9 APPLICATION FOR THE DIVERSION OF PUBLIC FOOTPATHS BA19/1 (PEASEDOWN ST JOHN) AND PART OF BA4/40 (CAMERTON) AT CARLINGCOTT MILL (BATHAVON WEST AND PEASEDOWN WARDS) (Report 10).

The Committee received a report which explained that Bath and North East Somerset Council had received an application for the making of a Public Path Diversion Order under section 119, Highways Act 1980. Following some informal consultations, objections had been received. The Committee was required to consider the application and objections and determine whether to authorise the making of an Order as requested or to reject the application.

The Committee considered the statement made by the applicant Mr Galizia, a petition from Carlingcott residents and letters from Camerton Parish Council and Peasedown St. John Parish Council.

Copies of the statement, petition and letters circulated to the Committee are available on the minute book.

On a motion from Councillor Warren, seconded by Councillor Willcox, it was RESOLVED that the Head of Transportation Access and Waste Management exercises his delegated authority to take all action to make a Public Path Diversion Order to divert Public Footpath BA19/1 and part of Public Footpath BA4/40, as indicated in the plan attached to this report as Appendix 3 and to confirm the Order, if no duly made objections are received (or if received are subsequently withdrawn).

10 BATH AND NORTH EAST SOMERSET COUNCIL (FOOTPATHS BA21/9, BA2/11 AND BA2/12, CHARMYDOWN FARM) PUBLIC PATH DIVERSION ORDER 2003 (Report 11).

The Committee received a report which explained that on 2nd April 2003 Bath and North East Somerset Council made a Public Path Diversion Order under section 119, Highways Act 1980 to divert parts of Footpaths BA21/9, BA2/11 and BA2/12, Charmydown Farm in the parishes of Batheaston and St Catherine. Following advertisement of the Order, two objections have been received. Despite negotiations these objections remain. The Committee was asked to consider the Order and objections and decide whether to forward the Order to the Secretary of State for the Environment, Food and Rural Affairs with a request that she confirms the Order as made or with modifications or that the Order is abandoned.

Nancy Davey, Wessex Water (landowners) informed the meeting that the fields south of the barns had been designated as access land by the Countryside Agency and that walkers could see the view from the gate. In response to Wessex Water, the Public Rights of Way Team Leader explained that the land has not yet conclusively been designated as access land and in any event the existence of access land should be disregarded for this application.

On a motion from Councillor Dawson, seconded by Councillor Griffiths, it was RESOLVED that the proposed Bath And North East Somerset Council (Footpaths BA21/9, BA2/11 and BA2/12, Charmydown Farm) Public Path Diversion Order 2003 be abandoned.

11 BATH AND NORTH EAST SOMERSET COUNCIL (PUBLIC FOOTPATH BA25/53, WELLOW) DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER 2003 (Report 12).

The Committee considered the objection made to the Bath and North East Somerset Council (Public Footpath BA25/53, Wellow) Definitive Map and Statement Modification Order 2003 prior to forwarding the Order to the Secretary of State for Environment, Food and Rural Affairs.

On a motion from Councillor Griffiths, seconded by Councillor Dawson, it was RESOLVED that the Bath and North East Somerset Council (Public Footpath BA25/53, Wellow) Definitive Map and Statement Modification Order 2003 be forwarded to the Secretary of State for Environment, Food and Rural Affairs with the request that she confirms the Order as made.

12 NOTICE OF ITEMS FOR FUTURE MEETINGS (Report 13).

There were no future agenda items.

The Committee requested that the quality of circulated maps should be clearer and printed in colour for future agendas.
