NOTES:

1. Inspection of Papers: Any person wishing to inspect Minutes, reports, or a list of the background papers relating to any item on this Agenda should contact Col Spring who is available by telephoning Bath (01225) 394358 or by calling at the Riverside Offices, Keynsham (during normal office hours).

2. Public Speaking at Meetings: The Council has a scheme to encourage the public to make their views known at meetings. They may make a statement relevant to what the meeting has power to do. They may also present a petition or a deputation on behalf of a group. Advance notice is required not less than two full working days before the meeting (this means that for meetings held on Wednesdays notice must be received in Democratic Services by 4.30pm the previous Friday).

The public may also ask a question to which a written answer will be given. Questions must be submitted in writing to Democratic Services at least two full working days in advance of the meeting (this means that for meetings held on Wednesdays, notice must be received in Democratic Services by 4.30pm the previous Friday). If an answer cannot be prepared in time for the meeting it will be sent out within five days afterwards. Further details of the scheme can be obtained by contacting Col Spring as above

6. Emergency Evacuation Procedure

When the continuous alarm sounds, you must evacuate the building by one of the designated exits and proceed to the named assembly point. The designated exits are sign-posted.

Arrangements are in place for the safe evacuation of disabled people.

Cabinet meetings will be supported by the Director's Group.

8. CONSIDERATION OF SINGLE MEMBER ITEMS NOW REQUISITIONED TO CABINET

This is a standard agenda item, to cover any reports originally placed on the Weekly list for single Member decision making, which have subsequently been the subject of an Executive Member requisition to the full Cabinet, under the Council's procedural rules.

9. CONSIDERATION OF MATTERS REFERRED BY OVERVIEW AND SCRUTINY BODIES

This is a standing agenda item (Constitution rule 21, part 4D - Executive Procedure Rules) for matters referred by Overview and Scrutiny bodies. The Chair(person) of the relevant Overview and Scrutiny body will have the right to attend and at the discretion of the Leader to speak to the item, but not vote.

10. COUNCIL PERFORMANCE REPORT FOR JANUARY TO APRIL 07

This is the Performance report detailing 4th quarter progress on all council statutory and key performance indicators alongside a detail narrative explaining performance, achievements and potential issues

11. REVENUE & CAPITAL OUTTURN 2006/07

This report presents the provisional revenue and capital outturn for 2006/07. The report refers to known potential pressures for the current year, as a preface to a request to carry forward specific budget items to 2007/08, and to write-off overspends where recovery in future years, in combination with containing those pressures in the current year, would have a major adverse impact on continuing service delivery.

12. STATEMENT ON INTERNAL CONTROL & CORPORATE GOVERNANCE 2006/07

The Accounts and Audit Regulations 2003 introduced a requirement for all Local Authorities to produce an annual Statement on Internal Control. This statement must be signed by the Leader of the Council and Chief Executive and included within its Final Accounts, all of which are subject to External Audit. This report records the findings of the 2006/07 review to date.

To enable a Statement to be produced, a review of the Council's system of internal control has been carried out. The 2006/07 review has followed the methodology used in previous years which was developed following consultation with Strategic Directors and the External Auditor.

13. GREATER BRISTOL BUS NETWORK LAND ASSEMBLY

This report identifies the need for the land shown in appendix one of the report to be available when the programme requires, and asks the cabinet to agree in principle to the use of compulsory acquisition powers if such powers become necessary due to breakdown in negotiations to secure land.

Note: Appendix 5 to the report contains information which is considered exempt from publication under Local Government Act 1972 (amended Schedule 12A) because it contains information relating to the financial or business affairs of any particular person (including the authority holding that information). Appendix 4 to the report is therefore the Public Interest Test document. Before beginning the debate on the item, Cabinet will be asked to consider the Public interest Test and then to determine whether Appendix 5 is indeed exempt from publication. Should Cabinet decide that the appendix is not exempt, copies will at that point be provided in the public gallery. Should the Cabinet agree that Appendix 5 is exempt, then no part of its contents may be divulged by any party during public debate. Should the Cabinet decide the appendix is exempt and wish to discuss the exempt appendix during the meeting, they will need to formally move the appropriate form of words to exclude the public from the meeting.
