NOTES:

1. Inspection of Papers: Any person wishing to inspect Minutes, reports, or a list of the background papers relating to any item on this Agenda should contact Col Spring who is available by telephoning Bath 01225 394942 or by calling at the Riverside Offices, Keynsham (during normal office hours).

2. Public Speaking at Meetings: The Council has a scheme to encourage the public to make their views known at meetings. They may make a statement relevant to what the meeting has power to do. They may also present a petition or a deputation on behalf of a group. Advance notice is required not less than two full working days before the meeting (this means that for meetings held on Wednesdays notice must be received in Democratic Services by 4.30pm the previous Friday).

The public may also ask a question to which a written answer will be given. Questions must be submitted in writing to Democratic Services at least two full working days in advance of the meeting (this means that for meetings held on Wednesdays, notice must be received in Democratic Services by 4.30pm the previous Friday). 6. Emergency Evacuation Procedure

When the continuous alarm sounds, you must evacuate the building by one of the designated exits and proceed to the named assembly point. The designated exits are sign-posted.

Arrangements are in place for the safe evacuation of disabled people.

8. MINUTES: WEDNESDAY 3RD SEPTEMBER 2008

9. CONSIDERATION OF SINGLE MEMBER ITEMS NOW REQUISITIONED TO CABINET

This is a standard agenda item, to cover any reports originally placed on the Weekly list for single Member decision making, which have subsequently been the subject of a Cabinet Member requisition to the full Cabinet, under the Council's procedural rules.

10. CONSIDERATION OF MATTERS REFERRED BY OVERVIEW AND SCRUTINY BODIES

This is a standing agenda item (Constitution rule 21, part 4D - Executive Procedure Rules) for matters referred by Overview and Scrutiny bodies. The Chair(person) of the relevant Overview and Scrutiny body will have the right to attend and at the discretion of the Leader to speak to the item, but not vote.

12. JOINT WASTE CORE STRATEGY FOR THE WEST OF ENGLAND: PREFERRED OPTIONS DOCUMENT

Bath & North East Somerset Council is preparing a Joint Waste Core Strategy in conjunction with the other West of England Unitary Authorities, recognising the strategic benefits of a partnership approach. Consultation on the Preferred Options Document provides a further opportunity for public involvement in the emerging Core Strategy, the primary purpose of which is to identify locations for the development of strategic waste facilities for both commercial and municipal use.

Note: The full Preferred Options document is a large document, so it has been deposited at the Council's Public Inspection Points and can also be seen on the Council's website. A summary document was also issued with the report.

13. PUBLIC REALM AND MOVEMENT STRATEGY FOR BATH CITY CENTRE - DRAFT FOR CONSULTATION

A long-term Public Realm and Movement Strategy for Bath City Centre has been prepared in draft. It is recommended that the Strategy is now released for statutory public consultation prior to its completion and formal adoption by the Council. When the principles, within the Strategy have been agreed, it is intended that a developer contributions model will be consulted upon as an review of the B&NES Development Contributions SPD. Further public realm and movement strategies for Keynsham, Midsomer Norton and Radstock are planned as part of the forthcoming development of Regeneration Delivery Plans for each centre. These strategies will similarly seek to reflect the individuality and distinctiveness of each place.

Note: The Strategy document is very large, so it has been deposited at the Council's Public Inspection Points and can also be seen on the Council's website. A summary document in the form of a leaflet has been attached as Appendix 2 to the report.

14. BWR DEVELOPMENT AGREEMENT

The negotiations of a Development Agreement (DA) between Crest Nicholson Regeneration Limited (Crest) and Bath and North East Somerset Council for the Bath Western Riverside West (BWR West) development are now advanced and mean that the Agreement is close to completion. Cabinet approval is therefore now sought to proceed to exchange the DA. The Council's Development Control Team is currently concluding negotiations with Crest on the statutory planning agreement (Section 106) for BWR West, but the Outline Planning Permission for BWR West can only be issued once the DA is in place. This is because the DA will ensure the delivery of comprehensive development of BWR West as is required by Council policy set out in the Council's Adopted Local Plan and Supplementary Planning Document.

Note: This item contains a Public Interest Test document, relating to the five appendices. The Cabinet will be asked to agree that information contained within the five Appendices falls within paragraph 3 of the amended Schedule 12A of the Local Government Act 1972 - Information relating to the financial or business affairs of any particular person (including the authority holding that information) - and that disclosure of the information would be contrary to the public interest.
